Overview

The Tier 1 (General) scheme came into effect in the UK from 29th February 2008 when it replaced the highly successful HSMP. The Tier 1 (General) visa replicates many elements of the HSMP's eligibility criteria and documentary requirements.

Most potential applicants have many of the same questions and concerns. To make the scheme easier for applicants like you, we have created this frequently asked question section. What is the government fee for a Tier 1 application?

The government fee applicable for a Tier 1 application inside the UK is £840. If you have included any dependents on the application, then a further £129 is payable for each dependent.

 

How long does it take to obtain the Tier 1 visa?

All processing times are subject to the volume of applications received by the Home Office, however most applications take between 4 to 5 weeks to be processed. Please note this is only a guideline and we cannot guarantee your application will be processed within the given time frame. It is possible for an application to be fast tracked if you have a job offer or urgent travel, however this is subject to the discretion of the Home Office.

 

How long is the Tier 1 visa valid for?

The visa is valid for an initial 2 year period, which can then be extended for a further 3 years. This allows you the full 5 year period necessary to make an application for Permanent Residency or Indefinite Leave to Remain (ILR). The extension of the visa is based on the same points based criteria as the initial application, however applicants should note that they will retain points for age. Does the Tier 1 visa start as soon as it is approved?

For applications made inside the UK, the visa will commence from the date of approval. In the instance that an application is made from outside of the UK, you will be able to post date your visa for up to 3 months in the future. Alternatively the visa can start from the date of approval.

 

Does the Tier 1 cover my spouse and children?

All Tier 1 holders are permitted to bring both their spouse and dependent children to the UK with them. These applications can be made at the same time as the main application or at a later date, depending on individual circumstances.

 

Can my spouse work in the UK?

The Spouse of a Tier 1 visa holder is permitted to work in the UK on exactly the same basis as the main applicant; there are no restrictions on their employment at all.

 

What kind of work can I do on the Tier 1 visa?

The Tier 1 visa allows you to work in any job for any UK employer. Furthermore, contrary to popular opinion, the job title and responsibilities are not a condition of applying for or extending a Tier 1 visa, providing you score the required points. Alternatively, applicants can work as a contractor, on a self employed basis or even start their own business. The only consideration you should have is whether you will earn the required amount to qualify for an extension.

 

Can I study on the Tier 1 visa?

The Tier 1 visa is a form of work permit and as such you should be working full time in the UK. The Tier 1 visa does permit you to study on a part time basis, but if you intend to pursue full time education you should consider a student visa.

 

Do I have recourse to public funds?

The Tier 1 visa does not allow you recourse to public funds such as housing or unemployment benefit but it does allow for several key benefits. Applicants and their family are permitted free medical care through the NHS and dependent children are given free schooling.

 

How much money do i need to show in my bank account?

The new maintenance criteria means that you should have at least £800 in savings to support yourself in the UK. Additional funds will also be required if you are including any dependents on the application. See the maintenance eligibility criteria for further details on the required funds. Please note the funds must be in your account as close of business everyday.

 

Do I need to sit for IELTS?

You will only need to sit an English language test if you did not complete a degree qualification that was instructed exclusively in English. Additionally nationals from English speaking countries will not need an English language test. See the English language eligibility criteria for further details. What documents will I need for the Tier 1 application?

You will need to supply documentation demonstrating your age, education, previous earnings as well as providing documents to demonstrate your English language ability and maintenance funds.
