Overview

A spouse visa is simply permission or the right to have leave to enter the UK based on your marriage to either a UK citizen or an individual who is settled and present within the UK . The visa when granted allows the spouse to live and work in the UK without restriction and can ultimately lead to ILR and naturalisation.


Eligibility

All spouse visa applicants must meet the following eligibility criteria to qualify.

Age

Both the Spouse and UK citizen or permanent resident that they are marrying must be over 21 years old on the date that the Spouse arrives in the UK if applying from overseas.  If you are applying for a Spouse visa in the UK, both the Spouse and UK citizen/Permanent Resident must be 21 years old on the date the application is submitted to the UK Border Agency.


Relationship Requirements

The following requirements must be met for the visa to be granted:

  • The applicants must be legally married to each other
  • The applicants must plan to live together
  • The applicants must be able to support themselves without recourse to public funds
  • The applicants must have suitable accommodation for all dependents

Visa Duration

The length and type of visa awarded to applicants is dependent or their previous circumstances and the length of time applicants can demonstrate their relationship for:

  • If you have been together for less than 4 years you will obtain a spouse visa for an initial 2 years after which time you can apply for ILR.  

 


Restrictions and Considerations

Whilst the scheme covers all nationalities there are several restrictions applicants should consider:

  • If there is more than one husband or wife, only one is permitted to come to the UK
  • Applicants must have met each other prior to the application
